L’analyse du service médical rendu aux patients doit-il compléter l’approche réglementaire de l’exercice de la télémédecine ?

Abstract : Summary Context The practice of telemedicine, a remote medical practice, is addressing a legal framework in several countries including the France. A decree defines the various practices, describes the conditions of implementation and the organization contracted with the health authority. Is this legal framework sufficient to guarantee a medical service to patients (MSP). Method To address this issue, the controversy debate method was chosen. The debate was bringing together a practitioner of telemedicine (PS), a lawyer specialized in health and a counsellor of national order of doctors in charge of information technologies and e-health (JL). An original text was written by PS, then submitted to two other contributors to this debate in order to express their point of view. Results Three topics were debated. The first concerned the proof or not of a MSP by telemedicine practices and what might be its definition. The second topic is trying to clarify if a teleconsultation brings a MSP at least equivalent to that of a face-to-face consultation. Finally, the third topic is trying to clarify if the legal framework was necessary and sufficient to ensure a MSP at least equivalent to that of a face-to-face consultation. The introduction and conclusion were written consensually by the three contributors to debate. Conclusion This debate reveals several points of convergence and asks some questions. Must telemedicine be free of all legal frameworks to better meet the expectations of a society characterized by the immediacy and the consumerism for mobile health devices and apps? Might telemedicine practices refer only to medical ethics in order to guarantee a humanistic medical practice for patients? In other words, can the new practice of digital medicine always rely on a MSP, which might then be based less on clinical research and evidence-based medicine than on an uberization of digital health?
